Terms of Service - Membership Terms

These Terms of Service ("Terms") govern your access to and use of The Aesthetic Library, a membership product of The Aesthetic Collective Pty Ltd (ABN 11 630 090 283) ("we", "us", "our"), sold via our website and delivered through Shopify, Appstle and Tevello. By purchasing or using a membership, you agree to these Terms.
1. The membership
The Aesthetic Library gives aesthetic and cosmetic professionals access to an editorial content library, Canva templates, trend briefings and caption frameworks, a members' community, and related resources, organised by discipline and tier (The Edit and The Studio), as described on our website.
2. Eligibility
Membership is intended for aesthetic, cosmetic and wellness professionals and clinics operating in Australia, New Zealand, the UK, the US and Canada, and is not intended for personal or consumer use. You must be at least 18 years old and able to enter into a binding contract to purchase a membership.
3. Billing and subscriptions
- Memberships are billed monthly in advance, in AUD, shown in your local currency at checkout via Shopify Markets.
- Subscriptions renew automatically until cancelled.
4. Cancellation
- You can cancel your membership at any time via the member portal.
- When you cancel, you keep access to your current discipline libraries and community until the end of the billing period you've already paid for. Your subscription won't renew after that date, and access ends then.

5. Licence to use templates and content
Subject to your ongoing membership, we grant you a non-exclusive, non-transferable licence to use, customise and publish the Library's templates and content for your own clinic's or business's marketing, on your own channels. You may not resell, redistribute, sub-license or share Library content, including templates, calendars and briefings, outside your own business, including with other clinics, agencies or non-members.
6. Compliance disclaimer
The Social Standards, caption frameworks, trend briefings and all other content are provided as general editorial and marketing guidance only. They are not legal, medical, regulatory or advertising-compliance advice. You're responsible for ensuring your own marketing complies with the laws, advertising codes and professional or regulatory standards that apply to you in your jurisdiction, for example, AHPRA and TGA guidance in Australia, or the equivalent bodies in New Zealand, the UK, the US and Canada.
7. Acceptable use
You agree not to share your login or Canva connection with non-members, use the Library to compete with us, misuse the Members' Room community (including harassment, spam or promoting competing products), or otherwise misuse the service.
8. Intellectual property
All Library content, templates, briefings and materials remain the intellectual property of The Aesthetic Collective Pty Ltd, licensed to you as set out above, and may not be used beyond that licence.
9. Availability
We aim to keep the Library, community and integrations, including Canva and Tevello, available at all times, but we don't guarantee uninterrupted access and aren't liable for outages caused by third-party platforms.
10. Limitation of liability
To the maximum extent permitted by law, our liability to you arising from your membership is limited to the amount you paid us in the 12 months before the claim arose. Nothing in these Terms excludes any consumer guarantee or right that can't be excluded under the Australian Consumer Law or other applicable law.
11. Changes to the service or these Terms
We may update the Library's content, pricing for new members, and these Terms from time to time. We'll notify active members of material changes. Continuing to use the service after changes take effect means you accept the updated Terms.
12. Termination
We may suspend or terminate your membership if you breach these Terms, including through unauthorised sharing or resale of content.
13. Governing law
These Terms are governed by the laws of New South Wales, Australia, and each party submits to the non-exclusive jurisdiction of the courts of New South Wales. This doesn't remove any statutory consumer protections you're entitled to in your own country.

(Single Discipline, Build a Box, and the Full Library), as described on our website.
2. Eligibility
Membership is intended for aesthetic, cosmetic and wellness professionals and clinics operating in Australia, New Zealand, the UK, the US and Canada, and is not intended for personal or consumer use. You must be at least 18 years old and able to enter into a binding contract to purchase a membership.
3. Billing and subscriptions
- Memberships are billed monthly or annually in advance, in AUD, shown in your local currency at checkout via Shopify Markets.
- Subscriptions renew automatically until cancelled.
- Founding members: pricing offered during the founding cohort period is locked for as long as your membership stays continuously active. If you cancel and later rejoin, you'll be charged the then-current published price.

- You can cancel your membership at any time via the member portal.
- When you cancel, you keep access to your current discipline libraries and community until the end of the billing period you've already paid for. Your subscription won't renew after that date, and access ends then.
